Our terms are designed to provide our subscribers and visitors with a guideline as to how all aspects of our services are accessed and how you can and should interact with our services. This ranges from website terms of use to how to become a subscriber and what your subscription includes, to providing details as to how we use your personal information. Part 1 Terms of Use

Our services are provided by and maintained by us for your personal entertainment, information and communication. The services offered by us include features, content, tickets, benefits, exclusive discounts, competitions, prize draws and/or other promotions. By using these services either as a visitor or as a subscriber of one of our subscriptions, you may need to download software and/or content and/or agree to additional terms. If you choose to participate in any of our services you will be bound by any applicable and additional terms as well as these website terms of use.

    2. Parts of our services are only accessible to our subscribers and not to visitors. If you are required to register with us to access some or all of our content and/or extra benefits, you agree that you will keep your user name and/or password confidential and will not share this information with any third party. You also agree that you will not register multiple email addresses. We may terminate or restrict your use of our service if you violate these website terms of use or are engaged in illegal or fraudulent use of the service.

    4. We may, at our discretion change, remove, suspend or discontinue any aspect of our services at any time including the availability of any content (e.g. a community forum may be withdrawn).

Your use of our services does not grant you any rights in and/or our licensor’s intellectual property whether for commercial or non-commercial use. We grant our users a licence to access and use our services and intellectual property rights (subject to your ability to access our services as set out above) and to the following usage restrictions: you may use our services for personal, private and non-commercial purposes; and you must not commercially exploit, or sell any content appearing on our services (this does not apply to any user content posted by you and in which you retain ownership rights, see paragraph on user generated content below). In consideration for the rights that we have granted you under these website terms of use, you permit us to provide advertising and other information to you, including permitting our third party affiliates to do the same.

    We will always aim to provide you with the best service we can, but our service is provided “as is” and we do not and cannot promise that all of the information provided in our services will always be 100% accurate. The information provided by our services is for information purposes only and does not constitute advice. All our services are provided without any warranties or guarantees.

    Some of the information provided by our services is supplied to us by our third party partners. We have no control over third party content and we are unable to guarantee the accuracy of such third party content. You agree that you access any content at your own risk. Before relying on any information, whether it is from us or from our third party partners, we advise you to verify the accuracy of such information.

    Whilst we will do our best to ensure that our service is fully operational at all times, we are not responsible for and shall not be liable to you for any problems or temporary interruptions in using our services arising from factors outside of our control (e.g. technical problems from traffic congestion on the internet) or for any problems arising from participating in or from downloading third party content.

    To the extent permissible by law, we are not responsible for any loss or damage resulting from use of our services or from any content posted on or through our services.

  3. Limitation of our liability to you


    You agree, that to the extent permissible by law, your sole and only remedy for any problems, issues or concerns with our service is to stop using our services, whether as a subscriber or as a visitor using one of our services.

  4. Changes to our terms


    We may amend these website terms of use at any time to ensure that we remain compliant with relevant laws and regulations and to ensure that we are constantly improving your experience in using our services, so please ensure that you check our website terms of use frequently. By continuing to use our services after any changes are made, you accept those changes and will be bound by them.

  5. The law that governs our services


    Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Part 2 Subscription terms

Welcome to our subscriber terms. Please read these terms carefully as they will set out the terms for your subscription with us. Where there are differences between our subscriptions (for example, the type of your subscription or what it includes), we have set out these details below. Unless otherwise stated, any reference to a subscriber or a subscription shall include reference to all our subscribers.

In addition to these terms, you will also be subject to the individual offer terms which govern the specific offer which you choose. Such offer terms will be made available to you when choosing your pack/subscription/offer.

If you access one of our packs under a corporate subscription, these standard subscription terms will apply to your subscription as far as they are relevant. The duration of your subscription is determined by the corporate subscription holder.

  1. Brief description
    1. White Whisper – free subscription service
    2. Gives you full access to Culture Whisper content including opt in bi-weekly newsletters and push notifications. As a White Whisper, you are also entitled to receive a pair of free tickets during the first month following your registration. This pair of tickets can be redeemed on our ticket page. Please note that Gold Whisper have booking priorities for ticket over a period of 48 hours after tickets are released.
    3. Gold Whisper – paid subscription service
    4. Whisper content including opt in weekly newsletter and push notification. As a Gold Whisper, you are also entitled to receive a pair of tickets each month redeemable on the Culturewhisper ticket page. You can also benefit from exclusive discounts with brand partners, featuring on the Culture Whisper website.
  2. How do I become a Subscriber


    To become a subscriber, please visit membership page and select which one of our subscription or offers that best suits your need.

    You must be 18 or older and have the power to enter into a contract with us and are not prevented from doing so under any local laws.

    By registering to become a subscriber, you agree that you have given us accurate registration details, including payment information and will ensure that we always have up to date contact information.

  3. Your subscription contract with Culture Whisper


    By selecting a Culture Whisper subscription plan, whether it is a free plan (White Whisper) or a paid plan (Gold Whisper) you agree to enter into an Agreement with Culture Whisper that may or may not involve an initial charge followed by recurring period charges (either monthly or annual), depending on the plan you have selected.

    The contract between us ("Contract") will only be formed when we send you the Subscription Confirmation.

  4. Paid for Subscription – Gold Whisper


    By entering into this Agreement and selecting either a monthly or an annual subscription plan, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. Culture Whisper may submit periodic charges (monthly or annually as relevant) without further authorization from you, until you provide prior notice that you have terminated this authorisation or wish to change your payment method. Such notice will not affect charges submitted before Culture Whisper could reasonably act.

    By subscribing to Gold Whisper you are agreeing to pay recurring periodic subscriptions (monthly or annually) for an indefinite time until cancelled by you or us, on the subscription terms set out in the application form you have completed.

    Once we have received payment pursuant to condition 3, and payment has been validated by your bank, we will confirm acceptance to you of your registration by sending you an e-mail that confirms that you have been accepted (the "Subscription Confirmation").

    The price of the services will be as quoted on our site from time to time, except in cases of obvious error. Prices quoted include VAT.

    Payment for all services must be by credit or debit card. We accept payment with Visa, Amex and MasterCard. We will not charge your credit or debit card until we receive your subscription form.

  5. Ticket Redemption Policy


    Our complimentary ticket offers are exclusive to Culture Whisper members and are non-transferable and non-refundable. Tickets are subject to availability and are limited to a pair per person. If an event has sold out, you will be placed on a waiting list to which you will be offered an alternative ticket if they are available.

  6. Subscriber code of conduct


    When attending an event as a Culture Whisper subscriber, you commit to attend the event booked, be discreet, punctual and polite to all staff of the venue you attend.

    If you can no longer attend an event once you have already registered, you must notify us at least two days prior to the event by emailing [email protected] . Those who cancel with less than 48 hours notice and/or fail to attend the event they registered for, will not be eligible to claim future complimentary tickets and may be charged for the value of those tickets. If you can no longer attend an event due to another engagement, Culture Whisper will not be held responsible for re-scheduling complimentary tickets for an alternative date. Furthermore, members who need to re-schedule tickets are asked to please contact the venue directly.

    If, for any reason, we believe that you have repeatedly not complied with this code of conduct, we may, at our sole discretion, cancel your access to the subscription areas of Culture Whisper Site immediately and without prior notice. We may terminate your subscription, at our sole discretion, by emailing you at the address you have registered stating that the agreement has terminated.

Part 3 – Cancellation Terms

  1. Paid for subscription (Gold Whisper) cancellation


    To terminate your Gold Whisper subscription or change your payment method, log into your customer account and edit through the "Your Profile" tab and selecting "Subscription". You will not be charged for any cancellation. You can re-subscribe at any time following your cancellation, but we reserve the right not to permit any re-subscription where we have previously elected to terminate a subscription from you.

  2. Can I get a refund if I cancel?


    If you cancel within 14 days of the start of your subscription and haven’t redeemed any tickets offered on the Culture Whisper website or used exclusive Culture Whisper benefits, we will refund any payments received from you using the same method of payment that you used to purchase your subscription. You will not be entitled to a refund of your initial payment if you cancel after 8 days of the start of your subscription.

  3. Free subscription (White Whisper) cancellation:


    If you no longer wish to have a White Whisper subscription, you may terminate your account by sending an email to [email protected] . If you no longer accept these terms and conditions, or any future modification to these terms and conditions, you must cease using the Culture Whisper Site. Continued use of the Culture Whisper Site indicates your continued acceptance of these terms and conditions.

Part 5 – Anything else I should know

  1. Transaction concluded through our site


    Through culturewhisper.com you have the opportunity to acquire tickets, packages, goods, products and services, make bookings for venues and events and obtain other benefits and enter into commercial transactions ("e-commerce transactions"). e-commerce transactions may be available from third parties. It is important to note that where you enter into e-commerce transactions with third parties you will be required to enter into separate terms and conditions in respect of such transaction directly with such third parties. Culture Whisper cannot be held responsible for any transaction that you enter into with a third party.

  2. Notices


    All notices given by you to us must be given to Culture Whisper Ltd at [email protected] We may give notice to you at either the e-mail or postal address you provide to us when registering. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

  3. Transfer of rights and obligations


    The contract between you and us is binding on you and us and on our respective successors and assigns.

    You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.

    We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

  4. Linking to our site


    You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

    You must not establish a link from any website that is not owned by you.

    Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with the content standards set out in our acceptable use privacy policy

  5. Entire Agreement


    These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

    We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or implied from anything said or written between us prior to such Contract except as expressly stated in these terms and conditions or the documents referred to in them.

    The other party's only liability in relation to these representations, undertakings or promises will be for breach of contract.

    Nothing in this clause limits or excludes either parties liability for fraud.
